Case Study 3: The Hidden Camera – Public Interest or Invasion of Privacy?
Introduction
Investigative journalism helps expose corruption and illegal activities. Journalists
sometimes use hidden cameras to collect evidence. However, this raises ethical
issues such as privacy, fairness and accuracy. In this case, a journalist secretly
records a senior public oficial allegedly discussing a bribe. The news channel
broadcasts selected footage with the headline “Corruption Exposed!” The oficial
claims that the footage was misleadingly edited.
1. When Can a Sting Operation Be Ethically Justified?
A sting operation is justified when it exposes serious wrongdoing that afects the
public.
- It should serve the public interest.
- Journalists must verify the information.
- They should avoid unnecessary invasion of privacy.
2. Verification Before Broadcasting
Before broadcasting hidden-camera footage, journalists should:
- Check whether the recording is genuine.
- Review the complete conversation.
These steps help maintain accuracy and public trust.
3. Ethical and Legal Risks
**A. Violation of Privacy**
Every person has a right to privacy. The Supreme Court recognised privacy as a
fundamental right in the 2017 Puttaswamy judgment.
**B. Defamation**
False accusations can damage a person's reputation. Section 356 of the Bharatiya
Nyaya Sanhita (BNS), 2023 deals with criminal defamation.
**C. Misleading Editing**8
Removing important parts of a recording can change its meaning and mislead
viewers. Journalists must present evidence honestly.
4. Exposing Corruption Ethically
Journalists should follow these principles:
- **Accuracy:** Check facts before publishing.
- **Fairness:** Give everyone a chance to respond.
- **Accountability:** Correct mistakes openly.
- **Proportionality:** Use hidden cameras only when necessary.
- **Transparency:** Explain the purpose of the investigation.
- **Presumption of Innocence:** Do not declare anyone guilty before proof.
A suitable headline would be: “Secret Recording Raises Questions About Alleged
Bribery.”
Relevant Laws and Ethical Guidelines
1. **Article 19(1)(a):** Freedom of speech and expression.
2. **Article 19(2):** Reasonable restrictions on freedom of speech.
3. **Article 21:** Right to life and personal liberty, including privacy.
4. **BNS Section 356:** Criminal defamation.
5. **Press Council of India:** Norms of Journalistic Conduct.
Personal Evaluation
In my opinion, the sting operation may be justified because corruption by public
oficials afects society. However, the channel should verify the complete recording
and give the oficial a chance to respond.Journalists should reveal the truth without
misleading the public or damaging innocent people's reputations.
Conclusion
Sting operations are useful for exposing corruption. However, journalists must follow
ethical principles such as accuracy, fairness and privacy. The main aim of
investigative journalism should be to reveal the truth, not to create sensational news.
Responsible journalism helps protect public trust.
